Terms of use

About these terms
gito is run by 36TLabs Software Solutions (“we”). It lets businesses (restaurants, cafés, hotels, salons, shops and others) show what they offer and take orders and bookings, and lets guests order and book with them. By using gito you agree to these terms and to our privacy policy.
For guests
- You order from the business, not from us. The business sets its menu, prices, taxes and charges, prepares your order, and is responsible for its food, products and service, including refunds and complaints. We provide the app that carries your order to them.
- The bill is the business’s. Prices and totals shown in your cart are estimates. The amount on the business’s bill for your order is what you pay. A service charge is never added unless you choose it.
- An order counts once it’s sent. If your connection drops, your order shows “Not sent — waiting for connection” and the business does not have it yet. It is sent when you’re back online. Only an order the app shows as sent has reached the business.
- Payment. You pay the business directly, as it accepts (for example cash, card or UPI at the counter). gito does not take or hold your money.
- Your account. Ordering in the app and booking need a sign-in with Google or your phone number. Keep access to it safe; orders placed from your account are treated as yours. Ordering by WhatsApp needs no account.
- Don’t place orders or bookings you don’t mean to keep, or in someone else’s name.
For businesses
- You’re responsible for what you list and sell: accurate names, descriptions, veg/non-veg marks, prices, taxes and charges, and the licences and registrations your business needs (such as FSSAI and GST).
- Your GST is yours to decide. You choose your GST status, GSTIN and rates in gito, and gito charges GST only when you’ve said you’re registered for regular GST and entered your GSTIN. Bills are calculated from the prices and rates you set. We don’t give tax advice: check your settings with your accountant. You remain responsible for the taxes you charge, file and pay, and for e-invoicing where it applies to you (gito doesn’t make e-invoices).
- Bills can’t be changed once issued. gito numbers your bills in one series per financial year. To correct an issued bill, a manager cancels it with a reason; the cancelled bill stays in your records and the corrected one gets a new number. A paid bill is final.
- Reports and exports are for your accountant. gito gives you a GST report and files to export; it doesn’t file returns for you. Export what you need before you close your account. Bills stay in our records for as long as tax law requires.
- Use your guests’ details only to serve them and as the law allows, and keep your staff accounts to the people who need them.
- Keep QR stickers where they belong. A sticker you no longer use should be retired in the app.
- Plans. A new business starts with a free trial of a paid plan, then moves to the Free plan unless it pays. Prices are on gito.app/pricing and in the app. You pay for a month or a year at a time, in advance, through PhonePe; nothing renews by itself, so to stop, just don’t pay for the next period. Paying before your period ends adds the new period after it. When a period ends, the paid features turn off, and your data stays.
Using gito fairly
Don’t:
- break the law, or use gito to sell what you’re not allowed to sell;
- try to get into accounts or data that aren’t yours, or test our security without our written permission;
- overload, scrape or disrupt the service;
- copy or resell gito itself.
We may suspend an account that does these things, and we’ll tell you why unless the law stops us.
Our service
We work to keep gito running and your data correct, but we can’t promise it will never be interrupted. We may change or stop features; if a change takes away something a business pays for, we’ll give notice first.
gito and its software belong to us. Businesses keep the rights to their own content (menus, photos, logos) and let us show it in gito for as long as they use it.
Liability
We’re not responsible for the food, products or services a business provides, or for a business’s prices, taxes or conduct. To the extent the law allows, our total liability to a business for any claim is limited to what it paid us in the 12 months before the claim. Nothing in these terms limits rights you have under the Consumer Protection Act, 2019, or any liability that the law doesn’t allow us to limit.
Ending
You can stop using gito at any time and delete your account. Records that the law requires us to keep, such as bills, are kept as our privacy policy describes.
Law and disputes
These terms are governed by the laws of India, and disputes go to the courts of India. Please write to us first; most problems are solved faster that way.
Changes and contact
When we change these terms we update the date at the top, and tell you in the app if the change matters to you.
